I, Isaac Penney, of the County of Brown and the State of Ohio, concidering the certainty of death and the uncertainty of life, being of sound and disposing mind and memory and understanding, concidering the uncertainty of life, do make this my last will and testament in manner following, that is to say - 1. My will is that the expenses of my last sickness and funeral be paid first. 2. All debts by me owing at the time of my death. 3. The balance of my personal property be divided as follows one third to my wife, the remainder to be equally divided between all of my children - or my children’s children, except my son Richard who has received his portion in full. That being the arrangement between Richard and myself. 4. My wife to have one third of the farm I now live on (for) her lifetime, the remainder to be equally divided between: Isaac Penney, Mary Peters - formerly Mary Penney, Emoline McFarland - formerly Emoline Penney, William Penney, Hannah Penney, Lafayette Penney; Richard Penney having had his share of this farm deeded as his legacy reserves none. 5. The Balance or residue of my estate, real or personal, I devise and bequeath to be divided among such of’ my children as shall~:be living at the time of my death or their children. 6. Lastly, I do hereby constitute and appoint Henry H. Whereas I, Isaac Penney, on the 22 day of May 1857 made my last will and Testament of that day do hereby declare the following to be a codicil — To the same I do hereby give and bequeath to my son Lafayette Penney three hundred dollars in addition to what he was to receive out of the real estate.
